Terms and conditions
Article 1 – Definitions
In these Terms and Conditions, the terms listed below have the following meaning, regardless of whether they are used in the singular or plural:
1.1 Event:
Organized Event, including but not limited to entertainment or hospitality activities, such as bar experiences, nightlife activities, artistic or musical performances, and any other experiences offered through the Budapest Nightlife Pass.
1.2 User:
A natural or legal person who purchases a Budapest Nightlife Pass or related ticket for any participating venue or event organized or promoted by Budapest Nightlife Pass.
1.3 Terms of Use:
These terms and conditions for the purchase and use of tickets and passes offered by Budapest Nightlife Pass.
Intellectual Property Rights: all rights to intellectual property such as copyrights, trademarks, design rights, trade names, and database rights, as well as know-how and related rights.
1.4 Ticket / Pass:
An entry ticket or digital pass (including QR-code based access) granting access to participating venues and offers organized by Budapest Nightlife Pass.
1.5 Service Charges:
The fees charged by Budapest Nightlife Pass to the User when purchasing a ticket or pass.
1.6 Office Address:
Budapest Nightlife Pass operates from Budapest, Hungary.
Article 2 – Purchase of Ticket / Pass
2.1
If a User wishes to purchase a pass, the User must complete the ordering process and provide the necessary information. The User guarantees that this information is accurate, current, and truthful.
2.2
Upon successful payment, the User can download the ticket or pass immediately through the official website. A confirmation email will be sent within 60 minutes, providing another opportunity to download the pass.
2.3
If technical problems occur during the ordering process, the User may contact Budapest Nightlife Pass via the contact form on the website.
2.4
The User acknowledges that additional terms and conditions may apply to access specific venues or offers associated with the Budapest Nightlife Pass.
2.5
The User understands that, according to Hungarian consumer law, the purchase of leisure-related tickets or digital passes is excluded from withdrawal rights. Once a pass has been issued, it cannot be canceled or refunded without prior written agreement.
2.6
All tickets and passes remain the property of Budapest Nightlife Pass. The User is not permitted, without prior written consent, to:

sell or transfer the tickets or passes to third parties, directly or indirectly for commercial purposes;

include the tickets or passes in any form of promotion or commercial activity.
If such misuse occurs, Budapest Nightlife Pass reserves the right to invalidate the ticket or pass without refund.
2.7
Only the name holder of the ticket or pass has legitimate access to the associated offers and benefits.
2.8
Budapest Nightlife Pass reserves the right to set a maximum number of tickets/passes per order.
2.9
Budapest Nightlife Pass accepts no liability for any damages caused by ticket unavailability, incorrect information, or event/venue cancellations.
2.10
Coupons or vouchers can only be used if specifically offered during checkout and must be officially issued by Budapest Nightlife Pass.
2.11
Budapest Nightlife Pass reserves the right to refuse any order.
2.12
In case of government-mandated closures or restrictions affecting participating venues, the User will receive a value voucher valid for 2 years from the date of purchase.
Article 3 – Cancellation or Relocation of Events
3.1
Budapest Nightlife Pass reserves the right to cancel or reschedule events and partnerships when reasonably necessary due to economic, safety, or other valid reasons, including force majeure.
3.2
Force majeure includes but is not limited to war, civil unrest, government restrictions, natural disasters, strikes, power failures, public transport interruptions, and other unforeseen circumstances that make performance impossible.
3.3
Budapest Nightlife Pass accepts no liability for damages caused by event cancellation, postponement, or the quality of participating venues.
3.4
If an event is canceled, the User may be reimbursed up to the ticket price. Service fees are non-refundable. Budapest Nightlife Pass will not compensate for indirect or consequential damages.
Article 4 – Warranties and Indemnities
4.1
The User indemnifies Budapest Nightlife Pass against claims from third parties arising from unlawful use of the website or ticketing system.
4.2
The User guarantees not to use robots, scraping tools, or any automated systems to purchase or monitor tickets.
Article 5 – Payment
5.1
Users pay the prices indicated on the official Budapest Nightlife Pass website. Service fees may apply.
5.2
Prices include VAT unless otherwise stated and may change without notice. The price indicated during checkout is final.
5.3
Budapest Nightlife Pass accepts no liability for mistakes made during the order process (e.g., incorrect ticket quantity). Purchases cannot be canceled or exchanged unless explicitly stated otherwise.
5.4
If a refund is approved, service charges will not be refunded.
5.5
The payment system is secured to prevent unauthorized use of personal data.
Article 6 – System Interruptions
6.1
Budapest Nightlife Pass reserves the right to temporarily suspend or limit access to its systems for maintenance or updates.
6.2
Technical or procedural improvements may be made at any time without prior notice.
Article 7 – Privacy
7.1
Budapest Nightlife Pass collects and processes User data in accordance with the GDPR. Personal data will not be shared with third parties except as required by law or to protect legal rights.
7.2
If the User gives explicit consent, Budapest Nightlife Pass may use this data for marketing purposes (e.g., email, SMS, or social media updates). Users may withdraw consent at any time.
Article 8 – Intellectual Property Rights
8.1
All content, software, designs, and branding of Budapest Nightlife Pass remain its exclusive property. Users may not copy, reproduce, or register any related trademarks or domains.
Article 9 – Conduct
9.1
Users must adhere to all rules of conduct established by participating venues.
9.2
Venues reserve the right to deny entry or service if users violate house rules or local laws.
9.3
Venues may make photos or video recordings for promotional purposes. By using the Budapest Nightlife Pass, the User agrees to this.
Article 10 – Cancellation and Termination
10.1
Refunds or cancellations are only possible under specific circumstances communicated by Budapest Nightlife Pass.
10.2
Either party may terminate the agreement if the other party fails to comply with these terms after formal written notice.
10.3
Budapest Nightlife Pass reserves the right to cancel orders or invalidate tickets in case of fraud or misuse.
Article 11 – Amendments
11.1
Budapest Nightlife Pass reserves the right to amend these Terms & Conditions at any time. Updates will take effect upon publication on the official website.
Article 12 – Governing Law and Jurisdiction
12.1
These Terms & Conditions are governed by Hungarian law.
12.2
Disputes involving consumers will be submitted to the competent court in the User’s district of residence. For business Users, disputes will be handled by the competent court in Budapest.
12.3
If any part of these Terms is deemed invalid, the remaining provisions shall remain fully enforceable. Budapest Nightlife Pass will replace the invalid clause with one that reflects the original intent as closely as possible.
